Welcome to Leaf & Heir. By visiting leafandheir.com (the "Site") or buying something from us, you agree to these Terms of Service. Please read them carefully.

1. Who we are

Leaf & Heir is operated by OLTea LLC, based in Temecula, California. When these terms say "we," "us," or "our," we mean OLTea LLC doing business as Leaf & Heir. When they say "you" or "your," we mean you, the person using our Site or buying our products.

2. Agreement to the terms

By using the Site, you confirm that:

  • You are at least 18 years old, or you are using the Site with the permission of a parent or guardian.
  • You can form a legally binding contract.
  • The information you provide to us (including at checkout) is accurate and complete.

If you do not agree to these terms, please do not use the Site.

3. Our product

We sell Extra Virgin Olive Leaf Tea grown and harvested on a family farm in Temecula Valley, California. The tea is sold as whole loose leaves intended to be brewed and consumed as a beverage.

Olive leaf tea is a food product, not a medication or supplement. We do not make claims that our tea diagnoses, treats, cures, or prevents any disease or medical condition. Statements on our Site about polyphenols, antioxidants, or traditional uses are provided for general informational purposes only and have not been evaluated by the U.S. Food and Drug Administration. If you have a medical condition, are pregnant or breastfeeding, are taking medication, or have concerns about whether olive leaf tea is right for you, please consult a qualified healthcare professional before drinking it.

4. Orders, pricing, and payment

Prices for our products are listed on the Site in U.S. dollars and may change without notice. We do our best to keep product descriptions, photos, and prices accurate, but we do not guarantee that everything on the Site is error-free at all times. If we discover an error in a price or product description after you have placed an order, we will let you know and give you the option to confirm the order at the corrected price or cancel it.

We reserve the right to refuse or cancel any order, for any reason, at any time. Reasons might include suspected fraud, payment issues, inventory shortages, shipping restrictions, or any other circumstance we determine in good faith warrants a refusal.

Payment is processed at checkout through Shopify Payments and other payment processors. By providing payment information, you confirm that you are authorized to use the payment method you have entered.

5. Shipping and returns

Shipping terms are described in our Shipping Policy. Returns and refunds are described in our Refund Policy. Both are part of these Terms of Service.

6. Site content and intellectual property

Everything on the Site — including text, photography, video, logos, illustrations, design, and the underlying code — is owned by Leaf & Heir or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may view, share, and print Site content for personal, non-commercial use. You may not copy, reproduce, modify, distribute, or otherwise use any Site content for commercial purposes without our prior written permission.

"Leaf & Heir" and our logos are trademarks of OLTea LLC. You may not use them without our permission.

7. User-submitted content

If you submit reviews, comments, photos, feedback, or other content to us — whether through the Site, by email, on social media, or anywhere else — you grant Leaf & Heir a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, adapt, and display that content in connection with our business, including for marketing purposes. You confirm that the content is your own original work, does not infringe anyone else's rights, and does not include anything illegal, defamatory, or otherwise harmful.

You agree not to submit content that is unlawful, threatening, harassing, hateful, fraudulent, or otherwise inappropriate. We may remove any user-submitted content at our discretion.

8. Acceptable use

When using the Site, you agree not to:

  • Use the Site for any unlawful purpose or in violation of any local, state, national, or international law.
  • Attempt to gain unauthorized access to any portion of the Site, other accounts, or any connected systems.
  • Interfere with the Site's operation, including by introducing viruses, malware, or other harmful code.
  • Scrape, harvest, or otherwise collect information from the Site by automated means without our prior written permission.
  • Misrepresent your identity or affiliation with any person or organization.
  • Use the Site to harass, defraud, or harm others.

We may suspend or terminate your access to the Site if we believe you have violated these terms.

9. Third-party links and services

The Site may contain links to third-party websites or use third-party services (for example, payment processors, analytics, or shipping carriers). We are not responsible for the content, accuracy, or practices of any third-party site or service. Visiting them is at your own risk and subject to their own terms and privacy policies.

10. Disclaimers

The Site and our products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Leaf & Heir disclaims all warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Site will be uninterrupted, secure, or error-free.

We do not warrant that any specific health, wellness, or nutritional outcome will result from drinking our tea. Individual results vary. Olive leaf polyphenol content, while independently batch-tested, varies by harvest, season, and storage, and the figure of up to 45,300 mg/kg referenced on the Site is an estimate, not a guarantee.

11. Limitation of liability

To the fullest extent permitted by law, Leaf & Heir and OLTea LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — arising out of or related to your use of the Site or our products, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or related to these terms, the Site, or our products will not exceed the amount you paid us for the product giving rise to the claim, or one hundred U.S. dollars ($100), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Leaf & Heir, OLTea LLC, and our officers, employees, contractors, and agents from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these terms, or your violation of any law or the rights of a third party.

13. Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these terms or your use of the Site will be resolved exclusively in the state or federal courts located in Riverside County, California, and you consent to the jurisdiction of those courts.

If any part of these terms is found to be unenforceable, the rest of the terms will remain in effect.

14. Changes to these terms

We may update these Terms of Service from time to time. When we do, we will update the "Last updated" date at the bottom of this page. Your continued use of the Site after we post changes means you accept the updated terms. If you do not agree to the changes, please stop using the Site.
